Questions regarding the legality of chiropractors selling CBD related products continue to arise with many jurisdictions refusing to address it. Add the Texas Board of Chiropractic to that list. According to the Texas Chiropractic Association (TCA), the Texas Board of Chiropractic Examiners (TBCE) has received questions regarding the use and legality of Cannabidiol (CBD) products in Texas. According to the TCA:

There are no specific agency administrative rules or state statutes regarding the use of CBD products in chiropractic care. Licensees wanting to incorporate this type of treatment into their practice should proceed with care and consider the following before recommending CBD products to patients:

• TBCE has no jurisdiction over the regulation of CBD products.
• TBCE will not give an opinion whether any particular product is or is not legal to use or sell.
• Any TBCE licensee who has a question on this issue should consult with their private attorney.
• The Texas Department of State Health Services (DSHS) is considering a rule on CBD products; TBCE advises licensees to monitor DSHS action on the proposed rule.
