New Mexico Court Rules on Drugs and Advanced Training

Drug Prescribing Still Allowed & Tiering Remains

On July 31, 2013 the New Mexico Court of Appeals set aside a 2010 drug formulary that the New Mexico Board of Chiropractic approved in violation of the state’s Practice Act. In the same case, the Court found in favor of the New Mexico Chiropractic Board in regards to new training requirements they enacted for Advanced Chiropractic Physicians.

While the decision is being hailed as a victory among conservative chiropractic factions, Advanced Chiropractic Physicians in New Mexico may still use the original 2009 drug formulary, they can still add dangerous drugs to the formulary as long as they get approval from the Medical and Pharmacy Boards and the profession remains legally tiered in practice and training.
