Oklahoma & New Hampshire Respond to CBD Questions

Scope Issues Remain Unclear – Chiropractors Remain in Legal Limbo

Oklahoma and New Hampshire are the most recent states to chime in regarding the legality of chiropractors prescribing, distributing and recommending CBD products.

In a response to an Open Records Request to the Chiropractic Board of Oklahoma on this issue the Board provided 15 pages of documents in relation to CBD oil and chiropractic.

According to an August 28, 2018 email from Beth Kidd, the Executive Director of the Oklahoma Board of Chiropractic Examiners, the result of the review indicated:

“As I stated before prior to your request we had not discussed Cannabinoid.” 

In the documents released by the Oklahoma Board the Chair of the Board, Chris Waddell DC, stated:

“I am also curious about the use of CBD oil in chiropractic offices. We need to know if CBD is classified as a schedule drug, and, if it falls under our current scope.”

In another message included in the Open Records request Dr. Waddell stated:

"I'm thinking it's classified as a drug and out of our scope."

In New Hampshire, the Chiropractic Board was asked in regards to CBD and chiropractors:

“Has it been determined within our scope of practice to be able to make such suggestions if appropriate and warranted”?

In response Michelle L. Thibeault from the Office of Professional Licensure and Certification in the State of New Hampshire responded basically providing no guidance on the issue.

“The Board met on October 4, 2018 and asked that I send you a response. The Board would like to refer you back to the scope of practice RSA 316-A.  I have included the link for convenience. http://www.gencourt.state.nh.us/rsa/html/XXX/316-A/316-A-mrg.htm

Chiropractors are urged to check with their state boards regarding the legality of CBD products and chiropractic before jumping in.
